Angelina Jolie Y Brad Pitt They have been locked in a custody battle for their children since their divorce finalized in 2019, and a recently discovered document shows that the fight could have been even more complicated.
Lawyers of the Pernicious Star, 46, filed a document in December 2020 claiming that three of her six children with Pitt, 57, wanted to testify against her during the process. The former couple share Maddox, 19, Pax, 17, Zahara, 16, Shiloh, 15, and twins Knox and Vivienne, 12.
“The children whose custody is at stake are old enough to understand what is happening,” the document obtained by Us weekly read. “The trial will necessarily impact them emotionally. Three of the children have asked to testify. Making any of the children suffer what can be a useless and void procedure is more than unjustified. It’s cruel. “
The document was presented as part of Jolie’s ongoing attempt to have Judge John Ouderkerk removed from the case due to his alleged connections to Pitt’s legal team. The actress’s lawyers argued that the children shouldn’t even have been put in the position of wanting to testify because the judge should have been disqualified.
The Salt star first attempted to remove Ouderkerk in August 2020, claiming the judge did not disclose “ongoing business and professional relationships” with the Moneyball star attorneys. However, two months later, his application was canceled and the judge remained on the case.
Earlier this year, Jolie submitted additional documents alleging that the judge refused to hear evidence that she believed pertinent to the case, including testimonies from her children. “Judge Ouderkirk denied Ms. Jolie a fair trial, improperly excluding her evidence relevant to the health, safety and welfare of children, critical evidence to present her case,” the documents state.
Maddox, who is 19 years old and therefore no longer a minor, testified against his father in March. “It wasn’t very flattering to Brad,” said a source. U.S of the adolescent’s testimony. “He doesn’t use Pitt as his last name in non-legal documents and instead uses Jolie. Maddox wants to legally change her last name to Jolie, which Angelina has said she does not support. “
In May, Ouderkerk issued a tentative custody order giving the couple joint custody of the children. A source said U.S at the moment when the Eternal Star was “bitterly disappointed” with the decision and planned to use “everything she has” to fight the settlement.
According to court records, a hearing is scheduled for July 9. The activist wants to use the appeal to “demonstrate a clear, reversible and damaging legal error” on Ouderkirk’s part. Jolie’s appeal will be heard by a three-judge panel and attorneys for both parties will have time to present their arguments.
